These general terms and conditions apply to all services offered by Catering by Mohr GmbH & Co. KG. A contract is concluded only upon receipt of a written order from the customer (the word "order" in the email directly triggers an order). Written confirmation from Catering by Mohr GmbH & Co. KG is not required, but may be requested by the customer.
Offers
Our quotes are non-binding. Quotes that include the rental of a location and/or our vehicles are valid for two weeks. Requests must be placed at least eight business days in advance. For parties with more than 100 people, the order must be placed at least 14 business days in advance. The deadline for accepting quotes is Fridays at 10:00 a.m.
Orders
By placing an order, the customer confirms that he has read and accepted the General Terms and Conditions.
Please note that our delivery capacity is limited, as we want to give each order the utmost attention and care. All dishes are prepared fresh to order, ensuring the quality our company stands for. Therefore, please order as early as possible to ensure your preferred delivery time.
To ensure a smooth process, we require precise delivery/collection time slots, the mobile number of the on-site contact person, the exact delivery location, and the correct billing address (see also Delivery/Delivery Terms). At the request of many of our customers, we have created our new menu using a "modular system." This allows you to put together your own buffet. All components, including finger food and grilled items, are subject to a minimum order quantity of 10 items per item.
For orders of smaller quantities, we charge a 25% surcharge. For orders under €200, we charge a delivery fee, which is calculated based on distance/effort.
We would be happy to assist you in putting together your package – by phone or in person by appointment.
Extensions of flat rates
Hourly extensions of rental/drink packages in the locations:
The number of people used to calculate the additional hours is based on the number of people specified in the order. Subsequent changes are not possible.
Advertising and mailings
By submitting your offer and transmitting your data to us, we reserve the right to use it for advertising purposes until you revoke your consent. Our advertising purposes include communications via electronic letters (emails) containing content on current offers, menus, and notifications about special promotions. We value your time and are aware that we receive a flood of electronic messages every day. Therefore, we keep our messages as short as possible and limit them to a minimum of one advertising message per calendar month or 12 per year. Revoking the transmission of advertising-related data does not require the exchange of business-related data.
Use of a location
The premises must be left as the tenant found them. Rice, confetti, and similar items are not permitted. In the event of violations, we will subsequently invoice the tenant for the cleaning costs by an external service provider. Any additional contamination and/or damage will be charged to the tenant. The use of fireworks, both indoors and outdoors, is prohibited.
Changes
Changes to the number of people/food selection can be accepted for purely food orders and small events up until 11 a.m. on Fridays of the previous calendar week before the delivery date.
Planning for the following calendar week takes place on Fridays starting at 11 a.m. Changes submitted after this time cannot be considered.
Exception
For large events (100 people or more, events staffed by Catering by Mohr, at our own venue or partner venue) and weddings, adjustments are possible up to 14 business days before the event. Changes/adjustments are no longer possible within these 14 business days.
Delivery/Delivery Conditions
Delivery will be made to the delivery address provided by the customer when placing the order on the agreed delivery date. Delivery will be made to the best of our knowledge and belief. Despite our utmost care, deviations from the agreed delivery date may occur, which are beyond our control or responsibility. If we foresee this happening, we will contact you immediately by phone. Therefore, it is very important that you provide your telephone or mobile phone number when placing your order.
Any special circumstances affecting the delivery location, such as construction sites, street festivals, barriers, markets, long distances, parking facilities, more than two floors, etc., must be stated when ordering. We reserve the right to charge you for any additional costs incurred due to these circumstances.
Return/Collection of empties
The customer must return the empty containers to Catering by Mohr GmbH & Co. KG no later than three (3) business days after delivery. Please arrange a return appointment by phone after delivery. The empty containers must be returned free of food residue and pre-rinsed. Failure to comply with this deadline will result in an invoice for any additional costs incurred.
When booking additional dishes, cutlery, etc., these must be sorted into the containers provided, without any leftover food or waste.
If you would like Catering by Mohr GmbH & Co. KG to pick up your order, please indicate this when placing your order. Pickup will be arranged by appointment. Please ensure that the empty containers/tableware are complete and free of food residues at the agreed time. A flat-rate pickup fee based on the time and mileage will apply for pickup by Catering by Mohr GmbH & Co. KG.
The customer is obligated to treat the rental items provided to them with care. The customer is responsible for the rental items from the time of handover until their return. Unwashed empties are initially accepted subject to availability. Exact breakages and missing items can only be determined after the cleaning process has been completed. Any missing items and breakages will be charged at the current rate and invoiced to the customer.
Prices/Payment
Please refer to our website or our printed materials for current prices. Delivery within Dortmund is free for orders over €200 with Catering by Mohr GmbH & Co. KG (net €200 for corporate customers/gross €200 for private customers). For orders under €200 or outside of Dortmund, we will be happy to charge a flat delivery fee depending on the effort involved and distance. You also have the option of picking up your order in person at an agreed time and date. All prices quoted include VAT. We reserve the right to adjust prices accordingly in the event of changes to the law. Payment can be made either in cash upon return of the empties or, by arrangement, by bank transfer after invoicing.
Exceptions
Private individuals in general, as well as corporate clients holding events at our own venues, will receive their (provisional) final invoice approximately 14 days before the event, which must be paid no later than the last business day before the event. The same applies to weddings, where the provisional final invoice is issued approximately 14 days before the event and must be paid, less the deposit paid to date, no later than the last business day before the event.
Cancellations
Should you need to cancel a buffet for personal or company reasons, we will calculate the cancellation fees accordingly. Any costs already incurred, such as administrative expenses, purchasing goods, personnel costs, rent, etc., must also be invoiced. These costs are assessed individually depending on the complexity of the order and the time of cancellation. We take the legal provisions of the German Civil Code (BGB) into account to ensure that any damages incurred are justifiable for both parties.
The following guidelines apply:
Small events & food orders *:
- Cancellations after binding confirmation, on the day of confirmation, approx. 5% of the order value
- Cancellations up to 30 days before the respective event approx. 15% of the order value
- Cancellations up to 14 days before the respective event approx. 75% of the order value
- Cancellations up to 7 days before the respective event 100% of the order value
- Cancellations after binding confirmation, on the day of confirmation, approx. 10% of the order value
- Cancellations up to 220 days before the respective event approx. 20% of the order value
- Cancellations up to 90 days before the respective event approx. 75% of the order value
- Cancellations up to 14 days before the respective event 100% of the order value
- "Delivery fees" are not part of the cancellation costs
- When renting a location, cancellation fees of €5,000 (regardless of the order value) will be charged from the date of written confirmation.
Large events - celebrations (corporate or private) & weddings *:
* Large events with 100 people or more and/or events with booked staff
and/or events in our own or partner locations and/or weddings.
Complaints
Complaints and objections must be reported directly to the service manager on the day of the event. If no service manager is on site, please forward your complaints (including photos) to our office by email within two business days.
Complaints submitted later cannot be considered.
Events with cash sales
If you book us for your event where we will be serving your customers/guests with a cash register, you must ensure a minimum turnover of €500 per event day. If this amount is not reached, you will be responsible for covering the remaining amount.
If you cancel your contract with us, you must fully compensate the missing minimum sales amount of €500 per event day. This corresponds to a minimum cancellation fee of €500. Complaints: Missing items or defects in the delivery must be reported to the delivery driver directly or immediately upon discovery by calling Catering by Mohr GmbH & Co. KG at +49 231 17 97 55. They must be documented with photos so that we have the opportunity to rectify the situation immediately. We can only acknowledge complaints received after this time but cannot process them further.
Creditworthiness
Our company regularly checks and monitors your creditworthiness when concluding contracts and in certain cases where there is a legitimate interest, including for existing customers. Place of jurisdiction
The place of performance is the registered office of Catering by Mohr GmbH & Co. KG: Walter-Welp-Str. 10, 44149 Dortmund. The place of jurisdiction is Dortmund. Should individual terms and conditions be invalid, all others remain valid.
